Cockers in Need Agreement ADOPTION AGREEMENT This agreement is made and entered into on this day of , 2008, by and between the Cockers in Need Rescue and the following individual(s), hereinafter “Adopter”: Name: Address: Phone: Whereas adopter wishes to adopt, and Cockers in Need Rescue wishes to place for adoption, the following dog: Name: Color: Sex: Age: Now, therefore, for good and valuable consideration, the parties to the agreement agree as follows: 1. Adopter shall be asked to make a non-refundable donation of $250.00 (Cash or Money Order) for an adult dog over 1 year of age. For a puppy under one year, the adoption fee is $275.00. The donation shall be used to help Cockers in Need Rescue offset the large expenses incurred in rescuing, boarding and care for these dogs. 2. It is understood that this dog will be spayed or neutered within 10 days of adoption if not already done by Cockers in Need Rescue. Puppies will be spayed or neutered at the earliest possible time in accordance with a veterinarian’s recommendation, but in all cases, before the dog is 12 months of age. 3. All dogs placed for adoption have been examined by a certified veterinarian. If the dog’s past health records have been given by a previous owner, Cockers in Need Rescue will provide these records to the adopter. We attempt to contact the dog’s past veterinarians, but sometimes contact cannot be made. Even when it is made, we cannot assure the completeness or accuracy of the records. 4. Adopter shall provide routine and emergency veterinary care as needed. The dog will be placed on an inoculation program as described by a licensed veterinarian in order to assure and maintain the health of the dog. The dog will receive a rabies vaccination and be licensed in accordance with state and local ordinances. We also suggest you bring your new dog to his/her new vet within 30 days so they can see him while he's healthy and get a good baseline. He'll need heartworm preventative too. 5. Adopter shall not transfer the dog to any other person(s). If Adopter subsequently no longer wants the dog, Adopter shall return the dog to Cockers in Need Rescue. The adopter will notify us of any change of address of where the dog is kept. 6. The dog is being adopted as a companion only. Adopter shall not use the dog for guarding, protection, or breeding purposes. Adopter will not allow the dog to be used for medical or experimental purposes. 7. Adopter shall treat the dog humanely, particularly with respect to the provision of adequate food (preferably Natural), water and shelter. 8. The Adopter(s) NOT the children, accepts full responsibility for maintaining proper care of this dog, including food, water, safe exercise and shelter. Grooming is essential to this dog’s well-being; therefore, the “Rescue” cocker must be groomed on a regular basis by Adopters or a professional groomer. 9. This dog must NOT be maintained outside as a yard dog. The primary and only function of this “Rescue” dog is that of a companion house pet. This dog will be fenced or leashed and under control whenever the dog is outside the home where it resides. 10. If Adopter resides in housing which is rented, Adopter shall obtain permission from the landlord prior to the dog’s placement with Adopter. A copy of the lease approving pets in the rental housing will be acceptable. 11. Cockers in Need Rescue may make inquiries about and/or examine the dog at any time, upon reasonable notice to the Adopter. 12. In the event that Cockers in Need Rescue determines, in its sole discretion, that Adopter is not providing adequate food, shelter, veterinary care, or is otherwise in breach of any of its obligations herein, Cockers in Need Rescue shall be entitled to take back the dog and make appropriate arrangements for the dog’s care and/or re-adoption. Should such an event occur, the donation made by Adopter shall be forfeited. 13. Cockers in Need Rescue makes no representations or warranties concerning the health, temperament, and/or previous ownership of the dog, other than expressly stated herein. Adopter understands that Cockers in Need Rescue shall not be liable for any medical care, or treatment of the dog. 14. Adopter agrees to indemnify and hold harmless Cockers in Need Rescue, its agent, and representatives, for and against any and all manner of actions and causes of actions, suits, debts, dues, accounts, bonds, covenants, agreements, judgments, claims, and demands whatsoever arising out of or relating to the adoption, placement, and/or possession of the dog. 15. If any provision of the Agreement is or becomes void or unenforceable by force or operation of law, the other provisions shall remain valid and enforceable. 16.
